AN ORDINANCE REGARDING WORKING MEETINGS.

WHEREAS, the City of Bellemeade is best run by a well informed and efficient City Commission.

WHEREAS, the best method for having a well informed and efficient City Commission is to make sure Commissioners are educated about state and city laws and communicate with one another regularly.

WHEREAS, the regular monthly meeting should not be used to develop and write ordinances or policy, but instead to debate and give final approval to them. WHEREAS, working meetings (also known as Caucus Meetings) are used by other Cities within the boundaries of Louisville Metro to keep the legislative body members informed about ongoing events, to plan policy and educate members.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BELLEMEADE

Section 1.  In addition to the regular meeting previously fixed by ordinance, the City Commission of the City of Bellemeade will hold informal monthly Working Meetings.  Attendance at these meetings shall not be mandatory and these meetings will be open to the public.

Section 2. The monthly Working Meetings will be held on the first Monday of each month, if not a legal holiday, at 7 PM at the home of the Mayor, 107 North Chadwick Road, Louisville, Kentucky 40223.  If the meeting would fall on a legal holiday, then the meeting shall not be held that month.

Section 3. No final action will be taken at Working Meetings and therefore minutes will not be required, unless the Working Meeting also qualifies as a special meeting of the City Commission pursuant to KRS 61.805 et seq.

Section 4. This ordinance shall take effect from and after passage by the City Commissioners and publication as required by law.

Ordinance 2019 –

AN ORDINANCE PERTAINING TO CITY COMMISSION MEETING PROTOCOL FOR PRESENTATION OF PROPOSED LEGISLATION AND THE RECORDS AND MINUTES THEREOF.

WHEREAS:  Kentucky Revised Statutes empower duly incorporated governing bodies with legislative authority necessary for the good of its constituents.

WHEREAS:  An organized procedure is required to facilitate the process of legislation and that accurate records of the procedure and the results thereof are an absolute necessity and most often mandated by statute.

THE CITY COMMISSION DOES HEREBY PRESCRIBE AND ORDAIN

SECTION 1.  Order of business shall be limited to those items on the original agenda or an amended agenda.

SECTION 2.  Discussion on any topic or item shall be held only after a proper written proposal has been presented in the form of a motion for passage and seconded.  The motion then shall be discussed, passed as presented, passed as amended, rejected, or tabled for further study and consideration.

SECTION 3.  Statutes require that meetings and the records thereof be open to the public, but no statute currently guarantees any person who is not a member of the body or an employee thereof the right to speak at such meetings. Therefore, the decision to allow comments or questions from a nonmember shall rest in the hands of the Commission.

SECTION 4.  Minutes of the meeting shall be limited to a report of the action taken, to include the commission members who made the motions and seconds with the exception that specific questions related to the proposal and the answers thereto must be reported verbatim in the minutes along with the names of the questioners and respondents.

AN ORDINANCE AMENDING ORDINANCE 2019 – 7 ADOPTING THE JEFFERSON COUNTY, KENTUCKY, AD VALOREM TAX ASSESSMENT FOR THE CITY OF BELLEMEADE, KENTUCKY, AND THE LEVYING OF AN AD VALOREM TAX THEREON FOR CITY PURPOSES FOR THE CALENDAR YEAR JANUARY 1, 2019 TO DECEMBER 31, 2019.

WHEREAS, the Commission of the City of Bellemeade, Kentucky is authorized and empowered to legislate as necessary and proper for the good of the City.

WHEREAS, pursuant to the provisions of the Kentucky Revised Statutes, the City of Bellemeade is authorized for city tax purposes, to fix the tax levy and the due dates to levy and collect said taxes.

NOW THEREFORE, BE IT ORDERED BY THE CITY OF BELLEMEADE:

That Ordinance Number 2019 – 7, be amended to read

CITY OF BELLEMEADE, KENTUCKY

ORDINANCE NO. 2019 – 7

AN ORDINANCE ADOPTING THE JEFFERSON COUNTY, KENTUCKY, AD VALOREM TAX ASSESSMENT FOR THE CITY OF BELLEMEADE, KENTUCKY, AND THE LEVYING OF AN AD VALOREM TAX THEREON FOR CITY PURPOSES FOR THE CALENDAR YEAR JANUARY 1, 2019 TO DECEMBER 31, 2019.

Whereas, pursuant to the provisions of the Kentucky Revised Statutes, the City of Bellemeade is authorized for city tax purposes, to fix the tax levy and the due dates to levy and collect said taxes.

NOW THEREFORE, BE IT ORDERED BY THE CITY OF BELLEMEADE:

Section 1.      January 1, 2019, is hereby set as the assessment date for all property subject to city taxation within the boundaries for the City of Bellemeade, Kentucky.

Section 2.      The county assessment of the property situated within the City of Bellemeade, Kentucky, is hereby adopted as the City assessment for City and such ad valorem taxes as apply for the calendar year January 1, 2019 through December 31, 2019.

Section 3.      The City Clerk is directed to obtain a true copy of the county assessment of property within the corporate limits of Bellemeade and cause tax bills to be made out therefrom  and mail same in the month of September to coincide approximately with the tax bill schedule of the Jefferson County Sheriff’s Office. Each bill shall show lot, total assessment of the real property and improvements, the name of the supposed owner, the ad valorem tax rate, and the total tax bill amount.

Section 4.      Upon delivery of such bills, the City Treasurer of Bellemeade shall have the responsibility of supervising the collection of same. Collection of delinquent taxes shall be made in the manner prescribed by law.

Section 5.      The proceeds of such taxes are to be used for the general operation purposes of the City.

Section 6.      The ad valorem tax rate for the calendar year 2019 shall be and is hereby fixed at seven and one tenth (7.1) cents per $100.00 valuation of the property as assessed for taxation. Full amount of said tax shall be due December 1, 2019 and payable as follows:

  • Prior to December 1, 2019: Face amount of bill less discount of two percent (2%)
  • December 1, 2019 through (January 12, 2020) (December 31, 2019): Face amount of bill
  • (January 13, 2020) (January 1, 2020) through (February 12, 2020) (January 31, 2020): Face amount of bill plus penalty of 5%
  • After (February 12, 2020) (January 31, 2020): Face amount of bill plus penalty of 10%, plus interest at the rate of 12% per annum from February 1, 2020, until paid

Section 7.      This ordinance shall take effect from and after passage by the City Commissioners and publication as required by law.
